1. Agreement and operator

These Terms apply to diamondpaintingartkit.com and purchases from Diamond Painting Art Kit (“we,” “us,” or “our”). By using the website or placing an order, you agree to these Terms and the policies linked from them.

2. Eligibility and accounts

You must have legal capacity to enter a purchase contract in your location. If you use an account, you are responsible for keeping credentials confidential, providing accurate information, and notifying us of suspected unauthorized use.

3. Acceptable use

You must not use the website to violate law or rights, introduce malware, interfere with security, attempt unauthorized access, scrape data at a scale that burdens the website or violates rights, use false identity or payment information, or misuse promotions, chargebacks, returns, accounts, or support systems.

4. Products and descriptions

We aim to describe products accurately. Screen settings, lighting, compression, canvas rendering, drill materials, and production can cause reasonable color or appearance differences. Dimensions may have small manufacturing tolerances. We may correct errors, update information, limit quantities, or discontinue products.

5. Made-to-order production

Our diamond painting products are made on demand in China. Standard products normally require 1–2 business days of processing; custom products normally require 2–4 business days. Processing may begin soon after payment authorization.

6. Custom photos and customer content

When you upload or send an image, text, name, logo, or other material for a custom product, you represent that you own it or have permission to use it, that the requested use will not violate copyright, trademark, privacy, publicity, contractual, or other rights, and that the material is lawful.

You grant us and our production partners a limited license to copy, crop, adjust, transmit, and use the submitted material only as reasonably necessary to review, produce, fulfill, support, and document the order. We may reject content that appears unlawful, unsafe, technically unsuitable, or likely to violate rights.

7. Prices, currencies, taxes, and promotions

Prices and currencies may vary by destination, settings, or payment provider. Applicable shipping, taxes, and discounts are shown at checkout when available. Import charges may be payable by the recipient unless expressly collected. Promotions may have separate rules. Discount pricing does not remove statutory rights.

8. Orders and acceptance

An order submission is an offer to purchase. We may verify payment, identity, address, availability, custom content, pricing, and fraud indicators before accepting or fulfilling it. An automated confirmation acknowledges receipt but does not prevent correction of an obvious error or rejection of an unlawful or fraudulent order.

9. Payment

Card payments are processed through Stripe and supported card networks. You authorize applicable charges, represent that you are entitled to use the payment method, and agree to provide accurate billing information.

11. Cancellations, returns, and remedies

Our Returns, Refunds & Cancellations Policy explains the 24-hour cancellation request period, voluntary 30-day return window for eligible standard products, custom-product restrictions, damaged or incorrect item remedies, missing-drill support, and refunds.

Nothing in our policies excludes mandatory cooling-off, legal-guarantee, faulty-goods, consumer-guarantee, or misdescription rights that apply in your location.

12. Reviews and submissions

You retain ownership of original content you submit. By voluntarily publishing a review, photograph, testimonial, or feedback, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, and display it in connection with the store. Submissions must be honest, relevant, and lawful.

13. Website intellectual property

The website’s original text, layout, branding, code, graphics, and compilation are protected by applicable laws. Product imagery or referenced subject matter may belong to third parties. Rights holders may use our Intellectual Property Policy.

14. Third-party services

The website relies on services such as payments, hosting, security, logistics, and delivery. Their services may be governed by separate terms and privacy notices. We are not responsible for unrelated third-party websites merely because we link to them.

15. Website availability

We may maintain, update, secure, suspend, or change the website. We do not guarantee uninterrupted or error-free access, but this does not affect obligations relating to an accepted order or mandatory rights.

16. Warranties and disclaimers

To the maximum extent permitted by law, the website and general informational content are provided on an “as available” basis. Nothing excludes an express product promise, mandatory implied warranty, statutory guarantee, or right that cannot lawfully be excluded.

17. Limitation of liability

Nothing limits liability that cannot legally be limited, including fraud or other non-excludable matters. Subject to that rule, we are not liable for indirect or unforeseeable losses, business losses arising from a consumer purchase, loss caused by misuse, or loss caused by inaccurate information supplied by you. Where liability may lawfully be limited, aggregate liability relating to an order will not exceed the amount paid for the affected product unless law requires a greater remedy.

18. Governing law and disputes

These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict-of-law rules. Courts located in Kansas may have jurisdiction. This choice does not deprive a consumer of mandatory protections or court access provided by the law of the consumer’s habitual residence.

19. Changes and severability

We may update these Terms prospectively by posting a revised version and date. If one provision is unenforceable, the remaining provisions continue to the extent possible.
